Terms of Use

These terms are an agreement between you and Paul Stockton, trading as FartTracks, of Auckland, New Zealand ("we", "us"). By using FartTracks you agree to them. If you don't agree, please don't use the app.

1. It's a comedy app

FartTracks is for entertainment. It records, names, stores and shares sounds. It is not a medical device and does not diagnose anything, however impressive the recording.

2. Health information is general only

The Gut Check section gives general information about bowel screening, gathered from public health services. It is not medical advice, it may be out of date, and it may not apply to you. Always talk to a doctor about your own health, and see one promptly if you notice blood in your poo or a lasting change in your bowel habits.

3. Hygiene and safety: your own risk

You use FartTracks at your own risk. Please record through clothing, keep a sensible distance between your phone and your body, and clean your device after use. We are not responsible for any illness, infection, injury, damage to your device, or embarrassment that comes from how, where or when you use the app, to the extent the law allows.

Once you share a recording, the people you share it with can save it, replay it and send it on. We can't control what they do with it, so think before you share.

6. Age

You must be at least 13, or the minimum age where you live if that's higher. If you're under 18, you need a parent or guardian's permission.

7. Pro and payments

FartTracks Pro is a one-off purchase made through the Apple App Store or Google Play. Their payment and refund rules apply. Pro features may change over time, but we won't take away the core features you paid for without good reason.

8. Ads, sponsors and other websites

The free version shows ads and sponsor messages. Links to other websites, including health services, go to sites we don't control, and we're not responsible for their content.

9. The app is provided "as is"

We do our best, but FartTracks may have bugs, go offline, change, or stop altogether. Recordings can be lost. Keep copies of anything you can't live without.

10. Limits on our responsibility

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss of data, reputation or friendships arising from your use of FartTracks. Where we can't exclude liability, our total liability to you is limited to the amount you paid us in the 12 months before the claim, or US$10, whichever is greater.

Nothing in these terms takes away rights you have under consumer protection laws that can't be excluded, such as the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, or UK and EU consumer law.

11. You're responsible for what you share

If someone makes a claim against us because of content you uploaded or the way you used FartTracks, you agree to cover our reasonable costs, to the extent the law allows.

12. Changes to these terms

We may update these terms. If the change is significant, we'll tell you in the app. Continuing to use FartTracks means you accept the updated terms.

13. Governing law

These terms are governed by New Zealand law, and New Zealand courts have jurisdiction. If you live elsewhere, you may also have rights under your local law.
